How do I modify my divorce judgment or order?

You cannot modify your judgment or order unilaterally. In order to obtain a modification, you have to reopen your divorce proceedings and go before a judge.

Modifying your Parenting Plan

You or your spouse may modify your custody, visitation, or child support order if there are significant changes in circumstances, such as:

  • Your child is getting older, thereby increasing the financial needs
  • Your child has moved in with your ex-spouse
  • One of you has lost a job, obtained a promotion, or met with some other circumstance which changed your income
  • The primary parent has moved out of state

An experienced family law attorney, John A. Balent can explain the laws in simple language so that you understand your rights and obligations. Our office can help you petition for a modification in child support due to a change of income or visitation. We can represent you in parental relocation matters and address the necessary modifications in custody or visitation that may follow.

Modifying your Spousal Maintenance Agreement

You may obtain a modification to your alimony agreement if:

  • You or your spouse has had a change in income
  • The spouse receiving alimony has remarried
  • You or your spouse has incurred large medical bills
  • Reopening your Divorce Judgment or Order

Normally, once you and your spouse divide your property, the agreement is final. However, if you discover that your spouse hidden assets from you, you can petition the court to reopen your judgment or order and redistribute the assets fairly according to California's property division laws.

There are many circumstances which might warrant a post judgment modification. To find out if you qualify for a modification, please contact us for an accurate assessment of your case.
